1. About Creations and these Terms
Creations, a California corporation, operates Creations Prism Private, an invitation-only luxury travel membership, and offers creationsvip.com, the public website, Prism Private Member Access, and related travel and concierge services. Creations Prism Private is a service and membership name and is not a separate legal entity. These Terms are effective August 7, 2026 and apply to the Site and to services that expressly incorporate them. A Membership Agreement, trip confirmation, supplier condition, or other separate agreement may also apply to a particular relationship or journey.
2. Acceptance of Terms
By accessing or using the Site, you agree to these Terms as they apply to that use. Actions that create additional contractual obligations—including accepting an invitation, activating an account, executing a membership agreement, purchasing a paid service, approving an itinerary, or confirming a booking—require separate affirmative assent through the relevant interface or document. Acceptance of these Terms is separate from marketing consent, SMS consent, cookie choices, and any consent concerning sensitive information.
4. Invitation requests and Prism Private Membership
Prism Private Membership is extended privately. An invitation request is an inquiry and is not an offer, acceptance, reservation, or promise of membership. Submitting a request does not create membership. Membership begins only after Creations accepts the applicant and the parties complete the applicable Membership Agreement and activation process. That agreement governs membership fees, term, renewal, cancellation, benefits, and service standards and controls over these general Terms if the two are directly inconsistent.
5. Travel and concierge services
Creations may advise, arrange, coordinate, reserve, communicate with suppliers, support travelers, and provide concierge services according to the applicable engagement. Creations applies professional judgment and commercially reasonable efforts, but not every request can be fulfilled. Availability, imagery, descriptions, examples, preliminary proposals, and editorial content are illustrative and do not guarantee a particular property, aircraft, vessel, event, experience, outcome, or level of access.
6. Third-party travel suppliers
Airlines, hotels, resorts, villas, residence providers, aviation and yacht operators, transportation providers, restaurants, guides, event providers, insurers, and other suppliers may impose their own terms, waivers, identification requirements, schedules, and cancellation or refund policies. Supplier acceptance may be required, and availability may change without notice. A proposed option is not confirmed until Creations communicates confirmation. Nothing in this section limits an obligation Creations expressly undertakes in writing.
7. Pricing, quotes, fees, taxes, and currency
A quote identifies its currency, validity period, included services, known taxes and mandatory charges, deposits, service or supplier fees, and payment deadlines to the extent then available. Exchange rates and supplier pricing can change before confirmation. Card issuers or payment providers may apply conversion or transaction charges. Creations will not intentionally conceal a mandatory charge; if a supplier introduces or changes a charge before confirmation, Creations will communicate the revised total before requesting approval whenever reasonably possible.
8. Payments
Accepted payment methods, required deposits, authorization procedures, installment timing, and final payment dates are stated in the applicable proposal, invoice, payment interface, or agreement. By providing a payment authorization, you authorize the identified amount and purpose. Failed or reversed payments may delay or cancel a service, and reasonable fraud-prevention checks may be used. The public Site does not collect raw payment-card information; when a separate payment processor is used, its terms apply and Creations receives only the transaction information needed to administer the service.
9. Changes, cancellations, and refunds
Member-requested changes may result in Creations service fees, supplier penalties, fare differences, taxes, or other costs disclosed when known. Some deposits, tickets, reservations, and special arrangements are nonrefundable. Refund eligibility and timing depend on the applicable agreement and supplier policy; a supplier credit may be offered instead of cash where its terms permit. No-shows may forfeit amounts paid. Involuntary supplier changes will be addressed under the supplier’s rules and applicable law. A chargeback should not be used to avoid a valid cancellation term or confirmed charge.
10. Traveler responsibilities
Travelers are responsible for accurate legal names, valid passports and visas, entry and transit requirements, health documents, customs and immigration compliance, timely check-in, baggage rules, local law, personal safety, current advisories, and prompt review of confirmations. Travelers should disclose accessibility, dietary, or medical requirements early enough for coordination and should consider appropriate insurance. Creations may coordinate and provide general information but does not provide legal, immigration, medical, or tax advice.
11. Travel insurance
Travel insurance may be available from third parties. Any policy is governed by its own terms, conditions, limits, exclusions, and claims process, and coverage is not guaranteed. Travelers should review whether a policy addresses cancellation, interruption, medical care, evacuation, delay, baggage, supplier default, pre-existing conditions, and destination-specific exclusions. Insurance is not mandatory under these Terms unless a separate service or supplier requirement expressly states otherwise.
12. Accessibility and accommodation requests
Creations welcomes requests concerning mobility, vision, hearing, communication, dietary, medical, cognitive, or other access needs and will coordinate appropriate requests with suppliers. Third-party accessibility varies by property, conveyance, destination, and activity, so requests should be made as early as practical. Supplier-controlled accommodations are not guaranteed unless confirmed. Alternate communication methods may be requested through the Contact page or the Accessibility Statement at /accessibility.
14. Electronic communications
Creations may provide operational notices, confirmations, account messages, records, and documents electronically using the contact information and interfaces associated with the relationship. Electronic signatures and acknowledgments may have the same effect as paper signatures where permitted by law. Users should maintain current contact information and retain important records. Operational communications necessary to administer a request or journey are distinct from optional marketing communications, which may be managed through the applicable preference or unsubscribe method.
15. Privacy
The Privacy Policy at /privacy explains how Creations collects, uses, discloses, protects, and retains personal information and how individuals may exercise applicable privacy rights. It is incorporated into these Terms by reference for informational and operational purposes. Agreement to these Terms is not consent to every data practice; a separate consent or notice is provided where required, including for optional marketing and certain sensitive information.
16. User information, documents, and communications
Traveler profiles, uploaded documents, itinerary details, household and companion information, messages, photographs, and other materials may be used only as reasonably necessary to evaluate an inquiry, administer membership, plan and support travel, communicate with authorized people and suppliers, protect the service, and meet legal obligations. A person providing another individual’s information must have authority to do so. Users retain their rights in submitted material and do not grant Creations a broad advertising license over private member content.
17. Intellectual property
Creations, Creations Prism Private, the approved logo, Site design, text, photography, Journal content, member interface, and software are protected by intellectual-property and other laws. Supplier marks and materials remain owned by their respective owners, and user-owned material remains subject to the rights described in these Terms and the Privacy Policy. The Site may be used for personal, noncommercial purposes related to the Creations relationship; copying, publication, modification, or commercial exploitation requires permission or another lawful basis.
18. Acceptable use
You may not use the Site or Member Access unlawfully; commit fraud; impersonate another person; misstate representative authority; share credentials; seek unauthorized access; scrape private or restricted content; introduce malware; interfere with operation; infringe rights; bypass security, rate limits, or access controls; or misuse private travel, household, itinerary, or security information. Creations may investigate suspected misuse and take proportionate protective action consistent with applicable law.
19. Third-party links
The Site may link to supplier, government, insurer, payment, mapping, or other third-party sites for convenience or travel fulfillment. Those sites may have separate terms, privacy practices, accessibility characteristics, and security controls. A link does not make Creations responsible for third-party content or practices, but Creations remains responsible for obligations it expressly undertakes and will offer an alternate way to access its own services when reasonably possible.
20. Availability of the website and Member Access
The Site and Member Access may be affected by maintenance, outages, international connectivity, supplier-system failures, mobile limitations, cybersecurity events, or circumstances outside reasonable control. Creations may change or temporarily suspend features to maintain security or service. Member Access is a communication and information tool and is not a substitute for emergency services. A person facing an immediate threat should contact the appropriate local emergency authority and then use the verified Creations support channel when safe to do so.
21. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND GENERAL PUBLIC CONTENT ARE PROVIDED ON AN “AS AVAILABLE” BASIS WITHOUT IMPLIED WARRANTIES THAT CANNOT REASONABLY APPLY TO GENERAL INFORMATION. SPECIFIC WRITTEN COMMITMENTS, CONFIRMED SERVICES, AND NON-WAIVABLE STATUTORY DUTIES REMAIN GOVERNED BY THEIR TERMS AND APPLICABLE LAW. NOTHING IN THESE TERMS DISCLAIMS LIABILITY FOR FRAUD, WILLFUL MISCONDUCT, GROSS NEGLIGENCE WHERE NON-WAIVABLE, OR ANY OTHER LIABILITY THAT LAW DOES NOT PERMIT CREATIONS TO EXCLUDE.
22. Limitation of liability
To the maximum extent permitted by applicable law, Creations is not liable for indirect, incidental, special, exemplary, or consequential losses arising solely from use or unavailability of the general public Site when such losses were not reasonably foreseeable. Any allocation of risk for membership, paid services, bookings, or supplier arrangements is governed by the applicable written agreement and law. No arbitrary monetary cap or shortened claim period is imposed here. Non-waivable consumer rights, fraud claims, willful misconduct, and liability that cannot legally be limited are preserved.
23. Indemnification
To the extent permitted by law, you will be responsible for reasonable losses and third-party claims arising from your unlawful conduct, fraud, unauthorized representation of another person, material breach of these Terms, or infringement caused by material you provide. This obligation does not require a consumer to indemnify Creations for Creations’ own unlawful conduct, fraud, willful misconduct, or other responsibility that applicable law does not permit Creations to transfer.
24. Force majeure and travel disruption
Severe weather, natural disaster, epidemic, war, terrorism, civil unrest, government action, border closure, labor action, supplier insolvency, transportation disruption, system outage, and other events beyond reasonable control may delay, change, or prevent service. Creations will use commercially reasonable efforts to communicate and assist with alternatives, subject to safety, availability, supplier rules, and law. Additional supplier costs, fare differences, penalties, or conditions may apply, and refunds or credits remain subject to the applicable agreement and supplier policy.
25. Suspension and termination
Creations may suspend access or services for nonpayment, unlawful conduct, abuse, material breach, account-security concerns, safety risks, supplier restrictions, or legal requirements. When practical and lawful, Creations will provide notice and an opportunity to address a curable issue. Membership suspension or termination is also governed by the separate Membership Agreement. Provisions that by their nature should continue—including payment obligations, ownership, privacy, dispute provisions, and limits permitted by law—survive termination.
26. California governing law and venue
These Terms and any dispute between you and Creations arising out of or relating to the Site, Creations Prism Private, Prism Private Member Access, or any service governed by these Terms will be governed by the laws of the State of California, without regard to conflict-of-laws principles. To the fullest extent permitted by applicable law, exclusive jurisdiction and venue will lie in the state courts located in the California county in which Creations maintains its principal office and the federal courts serving that county. This provision does not deprive a consumer of a non-waivable statutory right or mandatory forum protection that applicable law does not permit the consumer to waive. Supplier contracts may contain their own governing-law provisions, and eligible matters may proceed in an authorized small-claims court where applicable.
27. International users
The Site is operated from California and the United States and is offered to visitors and clients in the United States and internationally. California law applies to the fullest extent permitted by applicable law, while non-waivable local consumer rights remain preserved. International travel may require cross-border transfer of traveler information to suppliers or authorities. Users are responsible for complying with applicable local law and destination requirements.
28. Changes to the Terms
Creations may revise these Terms to reflect service, legal, security, or operational changes. Each version will identify its effective and last-updated dates. Material changes will be communicated through an appropriate Site, account, or direct notice, and renewed affirmative assent will be obtained when legally required. Prior versions will be archived in Creations’ records and may be requested through the Contact page.
29. General terms
If a provision is unenforceable, it will be limited or severed to the minimum extent necessary and the remaining provisions will continue. A failure to enforce is not a waiver. You may not assign obligations or account rights without Creations’ consent; Creations may assign these Terms as part of a lawful reorganization or transaction while preserving applicable rights. These Terms and incorporated documents are the entire agreement about general Site use; separate membership, trip, supplier, and service agreements remain controlling for their subjects. 30. Seller of Travel disclosure
A California Seller of Travel registration number, expiration date, registered entity, TCRC status, and approved statutory disclosure are not stated on this page because current verified information is not available in the public business configuration. Any disclosure required for a particular transaction will be provided through the applicable booking or contractual materials when verified and required by law.
